Default Anyone know anything about AB 2942 that goes into effect in January, 2019?

Does anyone know any information about ab2942 I can not find anything about it. I know it goes into effect in January. It gives distinct Attorney’s office to request resentencing.

Here is what AB2942 says as it was passed Here I haven't read the law fully.

Thank you so much for this. Would they have to send the letter to the district attorney that was in charge of the case? Who does the letter go to?

Is this saying they have to been giving 15 years or more? Could someone who was giving 14 years and half way through the sentence apply?

Existing law and this bill explicitly state sentence has to be 15 years or more. This bill adds words to existing law allowing incarcerated to write to DA to request resentencing. How to convince DA to do that are questions for an attorney.

What gvalliant says is right. This law just gives the DA the right to ask for a sentence reduction (with no guarantee a judge will grant it -- as I know from my own experience).

I imagine it'll mostly be used when the DA wants to "thank" someone for cooperating. It will probably only be used in rare circumstances, just as the existing PC 1170(d)(1) allows the Secretary of the CDCR to ask for sentences recalls.

That's also rarely used, although the department has now gotten budget funds to explore using it more for inmates who have shown significant rehabilitation. Several of those recall petitions from CDCR are now in the courts. Our was one, but ultimately the judge denied it. :-(
