Hi everyone, my son has been in prison in NV for six years, possession of stolen vehicle, and burglary, now that his release date is here 12/21/13, they are bringing up warrants from 2009 (he's been in prison since 2007)! His burglary charge was a arrest warrant after he was in jail.
He has served time for all charges, now they are saying he will be released and sent to county to face more warrants. Does this make sense to anyone? Pl explain, I am devastated.
It is not at all uncommon to see. Warrant issuance may be for the original offense or it could be related to revocation actions, but in either event, being incarcerated does not preclude their issuance.
If they were lodged as detainers, then he should receive credit on those cases for the time in custody following the detainer being placed.
I would suggest retaining local counsel to start work on them early next week in an attempt to obtain resolution as quickly as possible.
