Default Garry Thomas Allen OK - 6 Nov 2012 Executed

The Oklahoma Court of Criminal Appeals has set a Feb. 16 execution date for a death row inmate who claims he is insane.

Fallin, a Republican, issued the stay for 55-year-old Garry Thomas Allen to give her legal team more time to consider a 2005 recommendation by the state Pardon and Parole Board to commute his sentence to life in prison without parole.

I don't think the governor has issued her findings yet. He was given a thirty day reprieve so she could review the case.

His date has been set for Apr 12.
"The governor met with the Federal Public Defender's office, the Oklahoma Attorney General's office and the victim's family to review Allen's case, and after examining the arguments and evidence presented, determined that clemency should be denied, and that the sentence of death shall be carried out, according to spokesman Alex Weintz. "

Default Garry Thomas Allen-OK-Scheduled for 6 November 2012

Bad news, fellow PTO members- I have heard recent news that Garry Allen's stay has been lifted- he has been set a new execution date of 6 November 2012

I asked myself what is happening with his left eye and I found the answer.
"When police found Allen in an alley, Allen fought with an officer, attempting to force the officer to shoot himself with his service weapon. The officer moved the weapon, causing the bullet to strike Allen in the left eye."

Allen spent two months in the hospital being treated for his injury.Since then, Allen has had numerous appeals alleging he has a mental illness and therefore cannot be executed.He alleges that the gunshot wound he received while being arrested and his prolonged stay in prison has made his mental illness worse.He and his lawyers have argued that he does not possess the mental competency to be executed, that he does not remember the day he shot Gail, and that there are days when he is unsure why he is imprisoned and on death row.However, in 2008, a 12 member jury was impaneled to determine Allen’s mental competency.They reject Allen’s claim of insanity and ruled that he was sane enough to be executed.

Bad news, ladies and gentlemen...the US Supreme Court denied certiorari in Garry Allen's case. He sadly will not be much longer for this world...
