Default He got caught smoking cigarettes in prison

So my boyfriend has a parole hearing coming October 2011, he got caught smoking a cigarette yesterday, he should get immediate release for his parole hearing, will him getting caught smoking a cigarette effect him coming home. I know they put him on a minor restriction, no phone calls for 3 days, no weight lifting, and no going outside for 10 days, I can visit him still, however, but the question I seek answer to is will him getting caught smoking cigarettes effect his parole gearing or is it not a big deal? I appreciate your feedback.

I don't have a fact based answer for you, but if I were you, I would plan on it being thrown in the equation on figuring out if he should be granted parole or not. Sorry.

In most systems it depends on whether he got a write-up or not. My gut feeling is that if they didn't put him in the hole, but only on restrictions, that they're not treating it as a major infraction and taking it all that seriously. Bottom line - it won't matter too much.

However, Parole boards like to think that people can follow the rules. Especially the really simple ones. And, if drugs were any part of his crime, they equate the whole "prison smoking thing" with the same behavior as
getting drugs - because tobacco is such contraband in prison. All the behaviors in scoring illegal drugs on the streets is mirrored in the smoking thing in prison. So, not a great call on his part.

Hope it works out for him, and suspect that it will...

I didn't know you're not allowed to smoke cigs in prison. My friend smokes them all the time. It's allowed in the prison he's at.

Oregon hasn't allowed smoking in prison since 1994. Washington State banned it shortly after.

Aside from the second-hand smoke, the price of cancer treatments for inmates would break the bank if they allowed smoking.

It was my understanding that tobacco was considered contraband in all jails/prisons, both county, state and federal.

Most state prisons in ky are non-smoking. Those that aren't, will be by next year.

It has been banned in state prisons but there is a ton of privately owned prisons that have contracts to hold state and federal inmates that allow it.

Smoking is allowed where my husband is, but only outside, not in the dorms.
