Default Need Help

Hello everyone!

My son was intially picked up for parole violation (not attending school). While in juvenile detention, the officers discovered a crime had taken place nearby our residence. When these officers questioned my son (he is a minor), no attorney was present, nor was I contacted of this interrogation. The next day after this took place, my son called me and said all of these investigators were asking him questions about that crime. Of course, my son "sang like a canary," not knowing what else to do. Can the law interrogate a minor without the presence of an attorney or a parent? I questioned one of my son's attorneys, and his reply was, "anything is possible in Texas."

I will check into that.. But if they mirandized him they may be able to make it stick.. Let me do some checking and I'll let you know.. Hey they have to prove that he was give the right to an attorney and that he waived that right or none of it is admissiable in court.. I do know that.. Even if he was in detention that does not matter.. It is a seperate case and they have to read his rights every time.. So he may have a loop hole.. Let's pray.. Let me know if they did read him is rights. either way I am going to do some checking.

Thanks a lot Shortie! My son's next court date is this month and this will be the pretrial. I am praying his new attorney get us a short sentence or no sentence at all. Let me know what you find out. Thanks again!!

did they read your son his rights.... that is very important and i think will will beable to get off on a technicallity for that.. Just tell him to keep his mouth shut even if he is scared.. Hopefully he has learned that lesson. unfortanatly it was the hard way...
