Success likelihood for Motion to Reopen Parole Revocation case
Does anyone know the likelihood of success on a Motion to Reopen a Parole Revocation case? My husband was arrested on a parole violation (not a new charge) and his parole has been revoked. I'm working to get the money together for the attorney to file the Motion to Reopen, but my husband doesn't think it will be successful. If not, then the next step is to file a Writ with the State Court. His violation was that he had a networking site account (Facebook). He has been on SISP parole for 6 1/2 years with no violations. He served 8 years 2 months on a 20 year 3G offense. Does anyone know if he will lose his street time? He says that he is under legislature prior to the new law that restricts 3G offenses from qualifying for mandatory supervision release and other restrictions imposed concerning early release, etc. We got together after he was paroled, so I have never been through this and it is really taking a toll on me. Any feedback would be appreciated. Thanks!
