Ok so my brother who is incarcerated in Quehanna Boot Camp at this time. His graduation date is feb 24rth, and the plan in motion was listed as graduation, half way house (somewhere in N philly) for 30 days, and than home.
So today the parole officer came out to check the house out, My mom showed him around, and he went through my personal stuff, which was in a completly different room than my brothers belongings, which i found very invasive. And than when he went to the baby's room, where the baby was asleep in his crib, he went over and felt all through out the crib.. Was that really necessary? my first question is; is he allowed to just start searching through my belongings in my room?
My mom recently had surgery done, so in front of her closet was a little messy and the parole agent was not able to get into her closet in her bedroom, but because of that, he denied our home for my brother.. is that a legit reason?
Does anyone know what this means for my brother, as in does he have to remain at the halfway house? Or are we able to have our home checked again, just with the front my moms closet cleaned out?
I'm not totally right so don't take my word but bobble probably correct me they might just make him stay n the halfway house until he gets an approved homeplan ur first question I can't answer I didn't go through that yet
Techincally, they can search any part of the house. If the home plan is approved, you are granting them permission to search at any time with no need for a warrant.
Personally, I think this search was kind of intense, which makes me believe your home was denied for more than just the messy closet, even though that's what they're telling you. You can contact the District Office and speak to the supervisor, to get a better explanation and possibly a re-evaluation.
