How to get a sentence to run concurrent

Hi I was wondering if any one knew how to get a sentence that my husband is doing to run cuncurrent to each other? Since it all happen at one time.

Has he already been sentenced? It is up to the Judge's discretion. But if he has not been sentened yet I would get the attorney representing Sam to ask for concurrent sentences. the Judge refusedto run ron's concurrent. So he is serving six years insted of two.

Eddie is running two sentences concurrently...but it can be a sticky situation to swing-so you want to have your lawyer try to make it happen earlier rather than later.

Eddie had already taken a plea on his second case, under the understanding that he could serve his time concurrently. Then because these things are so timing sensitive....it almost didn't work out!...As one of the cases was a NJ case and one was a NY case. His lawyer had to take a ride all the way from North Jersey way up to Lakeview Correctional in NY to insure this would all work out like it was supposed to!!!!! 9hours!
Needless to say, I thank the powers that be for such a considerate attorney. I was so afraid that it was going to happen!

-my point was to take care of trying to make that happen asap...and as my man says to me all the time. "Be like me.....be Billy Bad Ass and stay on top of shit baby." He says this in a kidding way of course, only because he knows I probably sweat these things more than he does. haha
He wouldn't really dare TELL me to look over his legal matters like that

I just do for my own sanity!

He has been sentence in 1992 and has got turn down on 2 appeals and i was just wondering if there is any new laws or any thing else that could be done to get all this time ran together. That way we can still have a life. Anyways thanks for even replying.

...sorry for my ignorance LaTonya. I'm not that familiar w/the system here even, forget all the way in Chicago. Have you already inquired about this w/his lawyer? Whether or not this is something he could still pursue?

Sorry I can't be more help....maybe you want to post this on the Illinois board and see if anyone from the Chicago area may no more. Assuming that is where he is serving time.

You are right Gina that is a good idea. You are no more ignorant then me in all of this i have no clue about all of this. I was really throwing it out there to see if any one else knew any thing. Anyways i have talk to many lawyers and all of them says yes but am not sure if they are saying it for the money sake or for the sake of it being true. the cheapest i found was 8,000 dollar lawyer, May i add i am a mom and have a slew of other bills so that is not easy money to come up with. I hear ya...the single mom bit...bills and energy to find out about all this!!! WHEW!

...and you're right it's tricky to find the lawyer that isn't just trying to sell you pipe dreams. I'd try to speak to some legal aid attorneys first....maybe you could get some honest advice first, before putting yourself $8,000 in a whole for no reason.

Welcome to PTO. As for your husbands situation, only a judge can make the decision to run sentences concurent. There are no new laws regarding this. For money you can pretty much find a lawyer that will try anything. Remember he gets paid wether it happens or not. He's not taking a gamble. Being that it's been 10 years, & you have already gone through two appeals, it is a pretty big gamble. Your chances of sucess are well below 50/50. If you have 8 grand to gamble with, take it to vegas bet on red, if you win take the 8 grand you win & use it to try, & pocket your original 8 grand, cause youd have a better chance in vegas than with the courts under these circumstances.-------Ken

I do too but the very sad part about this if i dont take this chance we are looking at anthor 15 years apart.

That is some kind of time...I can't even front on that. I am really feeling the separation and I haven't even had the sort of time part form my man that you have. So I totally understand you're feeling that you must do/try whatever you can.
Still saddling yourself w/$8,000 debt that might not do anything, is a big risk. It could make 15 years ALL THE MORE difficult. This is not to say it's NOT worth it either...
I might try to look for help from the public defender's office or write letters about your husband's case and seek some pro bono help?
-Just some ideas. Sorry it's not more help...but unfortunately the two of you DO have the time to try these actions first before investing yourself in more debt. You probably don't need that strain if you can help it.

that is all up to the sentancing judge .. they decide if it is to run concurrent.. if they stacked it or make them consecutive there is nothing you can do..
