Default Gaintime in Florida Prisons?

I have read posts about you guys checking your loved ones' gaintime. Where do you do this? I know they show the release date on http://www.dc.state.fl.us when you do an offender search. Is this what you mean? Thankz

every month around the 10th , they should take off 10 days if no DR's Cr's they take off 10days per month until they have reached the 85%

A DR is a disciplinary review and an inmate usually gets one when they have broken a rule, minor or large. Getting a DR usually means that the inmate will be sent to the box (seg/confinement) for anywhere from 30-90 days and he or she will usually lose gaintime as well. I am not sure of a CR, but I think CC is when an inmate gets a written warning on their card, but no action is taken at that time, though CC's add up and the more warnings they get the bigger chance that they will get in trouble with a DR. Hopefully someone can come along and tell us what a CR is, I'll check out the DOC site and see if I can find something on it.

once a person has received a DR and some of their gain time is taken, can they earn more gain time along the way?

Yes...they can earn gain time again...after several months...it depends on the DR how long it is before they can earn gain time again. None for the month they receive the DR and if the DR carried 30 days loss of gain time as the maximum punishment, then, they can not earn gain time for the month they got the DR, plus 2 more months...if the DR carried 60 days loss of gain time as the maximum punishment, then, they can not earn gain time for the month of the DR, plus 4 more months. I believe what she is referring to is a CC (Corrective Consultation), which is also called a "write up" usually on a Contact Card, which is kept in the officers' station or somewhere secured. CC's are usually given when an officer feels that the punishment does not warrant a DR (or you are ok with the officer...lol...). You explained the situation very well, except that a CC can also make an inmate lose gain time....usually one CC might or might not make an inmate lose up to 4 days of gain time for the month he or she receives the CC. If the inmate get 2 or more CC's, he or she might lose all the gain time he or she can earn for that month. Hope this explains it. Take care, JACK

Hey, do you know if there's anywhere in writing stating how long they can not earn gaintime after receiveing a DR?? Like you posted, I know it depends on what the DR is for...but is that in writing or is it just whatever the prison feels like? I've been searching like crazy but couldn't find anything, only the amount of gaintime they could lose/how long they stay in confinement...My husband got a DR for possession of contraband for something that wasn't his..They gave him the DR a couple days later & he didn't even go to confinement..he lost 10 days gaintime for it which we thought ok no big deal..Well also now he can't earn gaintime for 4 months, and we thought that was a little extreme for something so stupid. Oh, and they said the contraband was a pornographic picture..it's not like it was a weapon or drugs or anything..Any info will be helpful, thanks!!!!

Can one corrective consult cause an inmate to lose ALL the gaintime for the month? My fiance didn't get any time for last month and when I contacted the CO he told me it was for some sort of security write up that he'd have to take it up with the Dorm Officer. My fiance is saying that shouldn't have cost him the full 10 days. It's hard not know this stuff and trying to call a CO when I don't even know the stupid lingo! UGH!!

My husband got a CC while in Reception and it only cost him 2 days. Not sure why they decided to take the full ten when it wasn't even a DR. Considering 4 days is the max you can get for security and then 4 days for working and then the classification officer can decide to give you 2-4 days additionally (typically they only give 2). So if it was a security violation the most he should have lost is 4 from what I understand. I'd suggest he file a grievance.

He may have also received only a "satisfactory" on his work evaluation for the month and lost gain time that way.

But a satisfactory won't pull all gain time. Typically it's 2 days for a satisfactory and 0 for unsatisfactory.

FL Statute:

944.281 Ineligibility to earn gain-time due to disciplinary action.--The department may declare that a prisoner who commits a violation of any law of the state or rule or regulation of the department or institution on or after January 1, 1996, and who is found guilty pursuant to s. 944.28(2), shall not be eligible to earn incentive gain-time for up to 6 months following the month in which the violation occurred. The department shall adopt rules to administer the provisions of this section.

FL Statute
944.275
For sentences imposed for offenses committed on or after October 1, 1995, the department may grant up to 10 days per month of incentive gain-time, except that no prisoner is eligible to earn any type of gain-time in an amount that would cause a sentence to expire, end, or terminate, or that would result in a prisoner's release, prior to serving a minimum of 85 percent of the sentence imposed. For purposes of this subparagraph, credits awarded by the court for time physically incarcerated shall be credited toward satisfaction of 85 percent of the sentence imposed. Except as provided by this section, a prisoner shall not accumulate further gain-time awards at any point when the tentative release date is the same as that date at which the prisoner will have served 85 percent of the sentence imposed. State prisoners sentenced to life imprisonment shall be incarcerated for the rest of their natural lives, unless granted pardon or clemency.

this won't apply in King's case since he didn't receive a DR. It was simply a CC which is only on file in the dorm. I think the CO is BS'ing me. King said the guy is a real jerk but he's always pleasant to me when I call even when I keep asking the same question (which this time was, "so you are saying he can't get any gaintime at all even though he got a satisfactory for work...you are saying that it's not so many points for work; so many points for behaviror correct?") There seems to be no way around it! He's in one of the worst places that is known for BS around the board. I'll be glad when he can go to work release.
