48 business hours. Weekends and holidays do not count.

What happens after the 48 hrs? Is the inmate just released to the street if ICE doesnt come within that time frame?

Yes of course, but these days it almost never happens. ICE picks up almost every single non-citizen and then sorts things out later.

Yes 48 hours is all they have and yes if they don't then they do have to release them but like MDawg Said it's almost a given that they will come and once they are in ICE custody there is no time table to have to deported back to their own countries at least I've been told they can hold them for how ever long they feel is necessary
Good Luck and God Bless Your Situation

like u all said the releasing to the streets will probably never ever happen, but if it would by mistake, does ice come looking for the inmate to his house or how do they get a hold of him?? and is there a penalty against the inmate??

My husband was actually released from jail. He was released in Dec 2007 on his exact release date. We had no idea of any holds. We were going along with our lives, our brand new start, he was getting to know his 8 month old daughter then.....BAM ICE picked him up at one of his probation appointments 5 monthes later!!! So it is POSSIBLE that they will let him out. How likely I dont know. From what I hear majority dont even get released and ICE picks them up right away. But I do know that they will find you honey if there is a hold on you, especially if its an agg fel. So my adice is hire an attourney now...dont wait and get this over with as soon as possible. You wont get bail because of the agg fel and your one of the lucky ones if you know about this ahead of time to make arrangments. This is a very long process and I don't mean to scare you but it is reality and don't run from it....handle it

God Bless you and good luck to you and your family

It could be that ICE has a deal with the county to hold him. My nephew was in federal for 10 mos and her was a permanent resident. ICE picked him up from the feds and put him in a county jail until he was deported 3 weeks later. Sorry i wish i had better news for you, but like the rest said those heartless bast%$#s will not "forget" him. They could care less.

my hubby was given an ICE hold and was ssupposed to be picked up in 48 hrs........ well, ICE couldn't really pick him up because they only have a holding tank at their facility in our area.... so they would pick him up during the day and drop him back off at the jail at night. kinda stupid.

Do you have an attorney? If he is still waiting for ICE, the attorney may be able to do something. That is if everything is cleared, he has no bond, no house arrest holds, no nothing. Hope everything works out for you all.
