Default Sentencing Interview!

Just got word yesterday evening that they have scheduled my husbands interview with the person who is deciding the sentencing structure for him on Tuesday April 16th. (Sorry I can't remember who it is exactly whose conducting the interview... all I do know is this person is the one who gathers all the information and determines where in the sentencing guidelines my husband falls and what sentencing period to recommend to the judge). Anyway... I was wondering if anyone had any knowledge of how these things go... and what he should try to avoid and what he should try and say.

Default sentencing interview

Good Luck! Hope the interview goes well... Main thing is to tell the person who is doing the interview the truth... Insure they understand how remorseful he is for what happened. Tell them plans he has for his life in the future. How he wants to become a good member of society and how he will go about it. etc etc.....

Are ya'll in the federal system? If so, handling this interview properly will definitely make a difference when it comes to sentencing.. Lemme know..

there are some posts in the Road to prison forum that you might want to check out..they seemed very helpful....are sentencing interviews only for the fed system..because stephen never had one,he is at state level?

No, I believe they are part of the pre-sentence investigation that every state has a version of...my fiance's was after his trial and a week before the sentencing hearing. But nothing the defense's side did made any difference, the court was determined to make an example of my baby....

Just be honest and be as supportive as you can. Also be remoseful for the crime. They don't like it when people try to act like victims to the system even though in some cases they really are.

That is why then, the sentence is already decided as part of the plea...the PSI is ionly when the judge has to set the sentence, like after a jury trial.

Can you give me some advice on where i can find an example of a "Shock Probation"/"Supression Motion"? My baby is trying to file one for himself because the lawyer we hired seems to be preoccupied with the fact that he got him a plea deal, but now that he has been final sentenced, we believe that he may be eligible for "Shock Probation" but if he is denied, he can then be eligible for parole. He has been sentence to 5 years as part of his plea, but he has been locked up for 15 months just awaiting final sentencing. He has not yet made it to his final destination, but we are hopeful that he will be able to speak to his caseworker soon. Can someone help me find this information? This is our second time through the prison system, and not to mention countless times through just the county jails. I want to bring my baby home for good this time and the sooner the bettrer? Please help!!!

Hi Cricketprice2
Please tell me what this "Shock Probation/ Supression Motion" Is. I think I heard of it but I thought it was for Texas (I know how stuiped) Whats the pros and cons of it. Do I tell my lawyer about it or remind him of it ? Does the law apply in Arizona?? Thanks
