Default Divorce Proceedings

My boyfriend's ex wife filed for divorce in 97. SHe sent him forms to sign which he did. He heard nothing about it since. He asked me to call the LA Country Clerk, so I did, and found the petition on record but nothing else. WHat else needs to be done to finalize the divorce. I am clueless (and SO grateful for this site).

The x-wife probably did not pay the court filing fee so the divorce could be finalized. As far as Texas Law the petiton has to filed for 30-or 60 days and then a court date for Divorce is made.

I would think you could call and ask if he can file it since she let it go.

I'm new to this whole thing, the board, prison systems...chalk me up on the naive category please

Is there a quick divorce for inmates in California or are they the standard 6 month waiting period?

Silver, I don't know for sure but I believe it's the 6 months after the judgement of dissolution. I don't remember reading anything special for inmates some years ago.

You need to go down to the court house and request to see the divorce paperwork. If she did not pay the fee, see if possible me may. If not he can divorce her himself. Her in Illionis it only cost $1.00 as long as there is no property and of course no support. She may have filed the papers and paid but did not send him his copy. You can check into it, the if there is a legal person there at his prison that does work for them, he can do the paperwork there for him, it may cost something but being he is there, it may not cost much. Just check into it and let me know. I was divorced in California so I am familiar with Divorce laws. I now live in Illionis and married here.

some one has to file the dissolution of marriage papers and the judgement papers.. you only have 6 months from the date to file them by cali law.. He may have to start all over again..
