** URGENT ACTION REQUEST FOR BRIAN DAVIS **
Please call, email or fax Governor Rick Perry today.
Brian Davis, a 32-year old white male, is scheduled
to beexecuted by the state of Texas on May 7.
Brian Davis was convicted of the 1991 murder of
Michael Foster and sentenced to death in Harris
County, Texas.
An actual innocence claim was submitted to the
Texas Court of Criminal Appeals on April 15, 2002.
On April 29, 2002 the Texas CCA dismissed the
writ of habeas corpus and denied a stay of the
execution scheduled for May 7, 2002.
Please contact Governor Rick Perry and express
sympathy for the family and friends of the victim,
Michael Foster, and express concern that the state
of Texas intends to kill Brian Davis, in violation
of constitutional law which prohibits the execution
of an innocent person.
Please note that the power of executive clemency exists
to address errors and inequities in the legal system and
that the Governor should also consider this new evidence
in this case, and any mitigating evidence that the
jury was not presented.
