Exclamation car accident & injury-lawyer or no lawyer?

I didn't know really where to post this so i hope this is in the right spot.
Ok so here's the scoop. this past monday night i was driving home from class and there was a little bit of snow on the road so i was going much slower than the speed limit and was in my own lane and everything, and here comes this car toward me driving in the middle of the road so i honk my horn and somehow the car ends up in my lane and we collide in a head-on collision. We both were taken to the emergency room by ambulence. my poor car is totalled. Since then I am having trouble sleeping because every time i'm almost asleep the vision of the crash keeps going through my mind. when i finally do fall asleep i have nightmares about it. I freak out bad in the car any time we come remotely close to another car. As far as physical injuries, my knees are all bruised up (i had on my seatbelt) but the worse pain now is in my neck and back. They took xrays and they showed that my muscles are inflammed and spasming causing my spine to be completely straight, rather than in a normal almost "S" shape. I've missed the rest of my classes this week because of it all. The accident was completely the other person's fault. Her insurance rep is extremely rude. My insurance lady told me that I need to figure out how much I am going to ask for pain and suffering. Now here's where I need help. SHOULD I CONTACT A PERSONAL INJURY ATTORNEY FOR HELP? I have no idea how much to ask for. I was talking to the guy that i bought the car from initially to tell him i'd be looking for a new one soon and was telling him about the accident and he said with my emotional and physical injuries that i "have gold." I don't want to be unreasonable but i want what i deserve. Even with pain med and muscle relaxers in me I still have a great deal of pain, and it seems to be getting worse. Please, tell me what you would do because i am lost...I would have also made a poll but i don;t know how.

I have personally been on two car accidents that weren't my fault and I got an attorney both times. My sister was in one also and did not. I will tell you that the insurance people, including her own agent DID NOT look out for her, but tried to minimize her injuries and damages. You definitely want a lawyer. Call one that is well known in your area, with a large ad in the phone book and you should be OK. I would never go without an attorney in your situation. Do not talk to the other drivers insurance company at all without your attorney. Good luck.

call an attorney, there pay depends on how much you get so they will go after every thing you deserve. otherwise, just as 14auto said they will just try and make you go away.

I couldn't agree anymore with everyone here.. Car accident, I am going through it now.. Whatever you do, DO NOT discuss any negotiating with your insurance company they will (at least in my case) give you the lowest possible amount.. Get an attorney, and hopefully you can get it all resolved sooner then mine, but it is slowly coming to an end.. Honestly, you say that the neck and back injuries are all spams, well that is what they told me because at the E.R.all they did was take x-rays, you need to get in and have an MRI done of your Neck and Back this is how I found out that my injuries we more severe then even I thought.

I can not stress to you more, to document all the pain you are feeling, and please keep receipts on everything you buy regarding this injury/accident. I noted everything in a journal and have receipts and in the end it saved me a lot of digging for info.. My car was also completely total, so yes I would say try to find a Personal Injury Attorney, and not a company too big, I did that here, and found that just because they are well-known, and advertise a lot that this does not always mean they are good.. They never had time to return my calls, or answer anything, and so I had to switch.. Don't let this go, you could be paying for your injuries later down the road. It will be close to two years since mine, and I have experienced more pain since then, and will continue to have pain, but sometimes you just deal with it and realize that it will forever be a part of your life..

UPDATE:
well they did an MRI a week ago and I have a herniated disc (that so far has not ruptured) in/at C5 in my neck. It's been 3 weeks and I hurt worse than I did the day after the accident. I DID hire an attorney, she was recommended to me by one of my favorite teachers, he and his daughter have both used her and were extremely satisfied. So far, so am I. I settled with the "opposing" insurance company on the property claim only and ended up getting much more than I had originally expected so that's always good. I bought a new car, a 2004 Oldsmobile Alero. I still get very shaken up very easily when driving and I can't bring myself to drive past the place where it all happened, so i go quite out of my way to avoid it. my mom drove past there the other day and told me that there's still pieces of the cars and glass all over the side of the road right where we collided. as for my injury, i have meds for now, and an appointment with a pain management specialist at the end of the month and the doctor's office is setting up an appointment with the University of Iowa hospitals and clinics (very very large and excellent health care system/place) with a neurosurgical specialist. I will continue to keep everyone updated on new developments.
