Default Sentencing postponed,waiting on Probation Report Will the report help him?

My hubby took a deal of 4 years at 80% and the public defender mentioned in court that he wants to see the probation report so they put iff sentencing for 6 weeks so they can get it. My question is will that report help him any?

It could help or it could hurt...it will all depend on the particulars of his prior history, to include criminal history and drug use.

If the PD asked to review the probation report, my guess is the PD felt the plea was still too harsh and one only has so much time to rectify. After sentencing is way more complicated then, putting off sentencing for 6 weeks. While sitting in jail, one gets day for day credits.

So, when he went in he already completed probation through ab109 with flying colors so can that help him? I just dont want any surprises. Also whats day for day credit?

If he already took a deal for 4 years, that deal is done and is not going to get better after the court views the probation report. If the judge sees anything in it s/he doesn't like, s/he could reject the deal.

I dont know. The public defender said it cant go higher. I think its just a waste of time personally.
