Default Husband is being held past his sentence

Hello,
My husband plead guilty to two counts on September 16, 2005. The judge gave him 142 days credit for time served. He was sentenced to two years on two charges. One of the two year sentences was supposed to run concurrent with his remaining parole (16 months) and the two sentences ran consecutive to each other. So he was supposed to serve a total of 4 years which with the good time started in April 2005. So now it is 3 years later and he should be getting out with 1 year credit for good time. Just today they moved his mandatory release date from 2-13-09 to 1-15-10. So that is 2 more years on a 4 year sentence of which he has already served 3 years!! I am so frustrated. No one is giving me answers and I don't know what to do. He should be getting out this month!!! I am taking care of a 2 year old on my own so I can't do too much to help him. I don't know what to do!! HELP!!

First, see if you can talk to his counselor.
Second, contact his attorney or the DA on the case and see if they will tell you what is going on.

Don't let your heart stop beating yet - it may just have been an input error in the computer.

Default Your situation

Is he locked up on Colorado?

No matter.

I. Go to the state's home page on the Web. Click on Department of Corrections. It shouldn't be too hard to find grievance procedures, names of people (DOC employees) to contact. Start the process of challenging the Department's administrative action (changing his out date).

Contact the attorney who represented him when the deal was cut. Maybe he or she can help. Sometimes a letter from an attorney gets their attention.

Just because I'm curious, why was his out date reviewed in the first place?

This is odd, and I feel sorry for you. Please don't give up hope. Make phone calls until you can get answers!

UPDATE:
I just got a call today and I get to pick him up monday morning!! I am so excited and I cannot even believe it! I am really in shock right now. I am just glad the judge finally got things straightened out since his release date should have been over a month ago!
