Default After sentence is his past on record in other states?

Hi, My name is ANita Barron and I currently live in Fresno, California. My husband is incarcerated in Soledad Correctional Facility with two more years left on his sentence. I was wondering if anyone knew if we moved to a different state, would his record still show up from California if he ever got arrested again. He definately can't ever get arrested again or he will be 25 to life (third strike) Does anyone know if we could start fresh in a new state.

I would not see any way his record would not follow him regardless of what state he went to.

Yes, it'll be available to other states. However, prosecutors don't always run an put of state rap sheet; it depends on how serious the case is.

There were states that didn't have a 3rd strike law, but I haven't researched this recently. Still, even without a 3rd strike, his record will follow him when it comes time to consider the sentence.

His record will be available nationwide to any law enforcement agency that runs it through LEIN (Law Enforcement Information Network). When I run people through, I sometimes get convictions that go back to the '60's and '70's. One thing to remember, however, is that it will only appear if someone took the time to input the information into the system. Generally, for felonies this is done without fail. With misdemeanors it's a toss up and some states are better than others.

Also, remember that while prosecutor's may not run a rap sheet if someone is arrested, pre-trial services usually does a bond report for the Judge on new arrests and they definitely will run the rap sheet. That way the Judge can make an informed decision as to how much the bond should be, or if the person is a candidate for a personal recognizance bond.
