Here is a link to the Interstate Compact Commission for Adult Offender Supervision, ICAOS, step by step instructions for him to apply for a parole transfer to Arizona.
https://www.interstatecompact.org/step-by-step

They have rules for both mandatory and discretionary transfers, and they will decide based on his application and history.

Can his California PO office hurt his chances? Probably yes, but he needs to determine the appropriate way to apply.

Default Looking for insight

Hello looking to gain some insight from you all,
My husband and his twin brother were sentenced to the same sentence- non violent , first time offenders- 10 years- and 3 years into the sentence had the rest of the time suspended and are immediately eligible for parole. I have moved from South Dakota to Minnesota and now own a home with their sister. Both have applied for interstate compact to Minnesota and we do know their pay work is in Mn hands now. We are at the 4 week mark that MN has had it, with no contact from any P.I. or anyone. Other inmates tell him we need to be calling po for our county and trying to get it moving . In my thinking I don't want to be pissing off the wrong person by calling and bothering him, any advice would be good

Interstate Compact works on a timeline... our po waited until 4days before his time frame ran out. It is a hurry up and wait situation. Bank on it taking the full 90 days. My husband was released on the 87th day. Prayers and good wishes sent to you all. I did send emails to the sending states compact office and they were really good about giving updates

ICAOS approval is based on the family connections, housing, and jobs they have available in Minnesota versus South Dakota. If the brothers qualify for a mandatory transfer too, they should both be approved.

Most government actions are driven by deadlines, but I hope the MN POs decide your cases quickly.

My boyfriend and I have been together for 14 years And we’re planning on getting married 10 years ago but, he had a 10 year sentence and his caseworker at the prison messed up the paperwork so he did not get a night but he did not get approved either. We are going to get married the day he gets out. Should he be able to get a fairly quick transfer I live in another state with a seven-year-old and we’re ready to start our family it’s been a long time!

Is it better to complete the interstate compact agreement after he's out on actual parole? I've heard doing it before is more difficult.

Once released & out on parole, it is my understanding that PO's may not approve a move until the parolee has shown that s/he can follow the parole stipulations.

I would think it would be easier to apply for IC before release. I am not an attorney....these are solely my opinions based on experience.

I don't know why MA wouldn't accept an offender for Interstate Compact (IC), unless the offender didn't fit the criteria. Here is a link to the Interstate Commission for Adult Offender Supervision website. The rules & the process for applying can be found on their page: HERE. FYI: Your man will have to have immediate family in Massachusetts according those IC Rules.

IC also has a page specifically for info about MA HERE.
