Default Modification Of Murder Sentence

Hi all
I am brand new to the forums.
I have a loved one serving a 50 year sentence for murder. He pleaded guilty.
He has served 9 years.
Does anyone have any suggestions on how to begin the process of getting a modification to his sentence? We are in Indiana.

I would encourage you to take a look through the Indiana forum located here as there may be some helpful information regarding this topic.
I myself am not too clear on the process in Indiana but one of the attorneys may have some thoughts.

Most people who plead out waive their right of appeal. He's not going to get a "sentence modification" aka "appeal" barring a habeas corpus demonstrating new evidence or the incompetence of counsel.

You should also know that he'll go back to square one. If they were threatening the death penalty before, they will be right back at it. He could find himself far worse off than he already is.

But, you should talk with licensed Indiana counsel. An hour of time with an appellate attorney would be worth the cost.

Fwiw, even if he went to trial, after 9 years he's waived everything except habeas corpus.
