Default Stipulation and early release in New Jersey?

My son had to take a plea deal on a 2nd degree criminal non violent for 55 Months with a stipulation of 25 months...Has anybody or a lawyer out there had a stipulation out there and got out earlier then their stipulation time and how much earlier then their parol stipulation you agreed on in NJ and how...

Welcome to PTO. I'm sorry you need us, but glad you found us.

I can't speak to NJ law, but it sounds like the "stipulation" is that he *has* to serve 25 months. I know it feels like forever to you, but it's a relatively short sentence as sentences go.

My guess (and it is only a guess) is that he won't be able to even go before the parole board until the 25 months are up. So it may be longer than 25 months.

I hope someone else comes along who knows NJ's system better than I do, and hopefully they'll have good news for you.

'round here, we tend to say that you're best off to plan for the worst and hope for the best.

Sorry to hear about your son. To the best of my knowledge it means he has to serve a mandatory of 25 months. It will go by Mich sooner than you think! Stay strong!

Thank You for you words. I know what it means the question was is there anybody out there that had a mandatory but got out earlier and how did they do it...

Hi JHarr, in reading NJ's Parole Handbook, it appears that offenders with a mandatory minimum sentence don't even qualify for most credits (Good Time, Work Credit + 2 other credits)....the one they do get (Jail Credit) doesn't come off the parole eligibility date, its deducted from the max. eligibility date.

IMHO, its highly doubtful that anyone with a mandatory minimum sentence gets released before they've served that minimum

If you look at your son's listing on the NJ Department of Corrections' website, you will see the date when he first become eligible for release on parole. I hope that helps.

Hi there,



I served two years in the NJDOC (2014-2016) and my sentence was a 5 year sentence with a 2 year mandatory minimum...hence, I know a LOT about stipulations!


I know you're not going to want to hear this but no, your son will not be able to be released a day before his 25 months are up. His back number (55 months) is subject to good time AND work credit reduction so that number will start to come down but unfortunately, Parole won't even consider him until his 25 months is completed. This also goes for ISP as well - they will not consider him a candidate until he finishes his stip.



I hope this helps and I'm sorry that you have to go through this! BELIEVE ME when I say this - the time will pass quickly and your son will be out before you know it.
