Default Charges were Dropped

My LO has been in the VDOC for several years.
He was a level 1 until a around a year ago. He was charged
with some "street charges" and his security level
was increased to a level 3. After all this time
the charges were dropped. He cannot get anyone
to do anything at the facility. What can he do now?

I ask this question in a different forum but I do not think I worded
the question correctly and should have posted it here.

Are you asking how he can go back to a level 1? Well, I’m not familiar with Va, however in Ca, the inmate sees a committee once a year to review their file. This is where his points would be reviewed for the appropriate level facility. Hopefully someone familiar with the Va process comes along, or you could ask your LO if they have a committee or team meeting annually?

Queen,

Thanks for the response. He was a level 1 prior to the charges. At that point
his level was raised to a 3 just because of the charges. Then moved to a level
3 facility. After months and months the charges were dropped. I guess the way
I see it they would have to restore his level 1 and move him back now.
It just really tough knowing he is were he is because of being charged with something he didn't do to be raised to a 3. Add to that he gets no cooperation from the people in charge who do something. Sorry about the venting.
The prison system just sux.

It’s better to ask and vent here, than to make waves or cause him undue problems. I know we all would like things done right away, but unfortunately I’ve learned they just don’t work that way. A similar incident happened with my husband; he was actually never classified with the Feds when he was transferred. 6 months later, at committee, his points went down by half but he was told he’d have to put in to transfer at the next committee hearing. It was one of those, are you serious, moments. Granted, he does have other mitigating factors, but I still truly understand where you’re coming from. ((Hugs))

It is unclear what is meant by 'street charges' but the claim that a 'charge was dropped' does not mean that the conduct did not occur. As such, it is fair game for consideration in any sort of classification or release decisions. It is the same reason parole supervision can be revoked on an affidavit even without a conviction...
