Question Need info Re:Health code violations?

What if you think that your husbands 8th amendment right is being violated, and he is subjected to crul and unussuial puishment on the basis of unclean enviroment, no proper ventalation and building maintnace code violations, where would I find info mation on the building codes and what exactly are the rules called that they are going against? Is there a website that has health codes, and infomation on what is harmful and what can be done about it?
thanks-

Good luck with that one. Pretty well settled federal case law - they only have to do what they "deem necessary" - and in some states they don't even have to comply with local building codes.

Absent finding a lawyer who is up on this in your home state, you'll need to camp out at the nearest law library and become a regular. I don't think you'll find much on the internet.
There are 2 separate areas of inquiry. 1st, getting up to speed on what your jurisdictions "housing" cases might be. You'd of course want to know teh prison cases, but in general civil housing issues might be important as well when it comes to what "habitability" means.
The, building codes are going to local administrative regulations (notoriously hard to research) but there are are also state standards. You'll in addition find an abundance of federal law on topic, especially regarding what "overcrowding" means.

I know that in CA, the issue of conditions in county jails are being examined by an outfit called the Prison Law Office, located in San Quentin, CA. They are a possible resource.
