My son took a plea bargin...he has 3 feonies...and many misdemenors. Felony Larceny, 2 Felony assualts, one with attempt to rob and one with intent to harm. The sentence in our state for all of these combined could be maximum 25 years. His bargin is 6 months. I think it is because he has never been in the prision system, no one was injured, nothing was stolen and he was completely HIGH on XANAX...doesn't remember anything and kept falling asleep in all the court appearances. They are only sentencing him to jail because the law required it. His public defender tried to get him TOTAL rehab for a sentence. All his stealing was to obtain more DRUGS.

Trespassing and attempted robbery. He and his cousin got drunk and stripped an abandoned house of copper wire.

Well My son took a deal of 12 yrs with half time and he had 799 days credit to his sentence. What happen in his case was that my nephew wich is his cousin asked him for a ride to drop somthing off because my nephew couldnt drive becasue he had been drinking and my son wasnt. So my son gave him a ride, so my nephew got off the car and seconds after my nephew got off my son heard gun shots and my nephew got back in the car and my son asked him what happen and my nephew said get out of here I dont want to talk about it. so my son drove off the the location they were at some familys house. Then they got pulled over and my nephew got off the car an ran. My nephew got tased by the officer and found a gun on my nephew. My nephew was a gang member and my son wasnt, but because my nephew was my son plead no contest to gang enhancement and to drive by shooting. If he would have not taken the deal and went to trial he would have got life in prison. My nephew got 50 to life. And mind me no one got hit by the bullets but because it was gang related. And either of them had any priors had a clean record.

My husband is doing five years for illegal re-entry into the US. My son is doing 14 months for eight felonies- 1 for each pill he had in his pocket.

Burglary/Building Dwelling which is BS - it was just a broken window! When we appealed, judge was like "I must have had a bad day when I sentenced you" - he got 5 in and 5 out - but was overturned and the latest date is 3/16/2011.

Burglary, repeat offender, sentenced to 20 years, serve 2 (thank goodness). The DA tried to throw the book at him and he decided to represent himself, so it could have been really bad. 480 days left.

Breaking and entering with probation revocation. Sentenced to 3 years for the B & E and has to back up 2 years for the probation revocation, judge ran them concurrent. Been in 223 days and 97 left
