Question Bond probation counting as backtime

Hello,
I know that usually a judge will grant "time served"/"credit towards sentence" for the time that an inmate sat in county jail for the crime committed. My question: if a person is bonded out for that crime and given probation stipulations while out on bond...can that time of "out on bond probation" also be counted as credit towards the sentence? Any input is greatly appreciated! Blessings to All~

Not in federal crimes, but it will depend on the rules/judge in your actual case/jurisdiction.

As a general rule, time on bond is NOT going to be credited towards a sentence in Texas.

You can always turn yourself in early though and surrender bond if you want to get time started on your sentence sooner, so you can get it over with and be released sooner come the end of your sentence.

The only downside of that approach is that you'll be doing more time in county jail which tends to suck compared to all the extra "creature features" and privileges you get once you get transferred to an actual prison.

But it's totally up to you.

Was given the 3 months backtime that was spent in county before getting a PR bond. The PR bond came with being put on probation including UA's, probation fees, and weekly reporting...did this successfully for 1 year and 4 months before the trial and found guilty. Once at the actual prison, was told by many that time spent on probation for bond can be counted as back time. Wrote to Huntsville requesting the credit who wrote back stating that was not handled by them and to ask a judge in the county of conviction. That's as much as i know haha but thank you for the info.! 😊

Let us know what you find out.

I've never heard of any jurisdiction that counted pre-trial street time towards one's eventual sentence, but I know a few jurisdictions actually credit TWO days time served for every day spent in pre-trial jail custody, which certainly sweetens up the pot and makes the prospect of staying in jail the whole time more enticing, since it means you'll be home that much sooner at the tail end of your sentence.

Look, if other inmates were telling him that time existed for bond supervision, then don't you realistically believe that every former TDCJ inmate who re-offended would be taking all possible steps to post bond given that it is not difficult to string a case out for a few years? MOST jailhouse rumors are crap. Nothing more and nothing less. CRAP!

There have been a very few very fact-dependent cases where credit was given, but those were not anything with general application to all persons on bond. Generally when it was awarded, it was because of very egregious acts by the State in delaying the prosecution of the case. In other words, something that doesn't happen very often.
