Default What are his chances if his post conviction was approved in Maryland

Hello - I am not sure if i am posting this in the correct section so please move it if it is not. My guy has been granted his post conviction and I am just curious as to what the exactly means. Does he have a chance to be released? He has done 19 years on a 60 year sentence.

What i am trying to find out is what are the courts' options when a leave to appeal is granted?

My understanding as an attorney practicing outside your state is that the odds of approving leave to appeal are pretty decent. The odds of the actual appeal being granted are much smaller. A lot depends on the composition of the courts, and I don't know how liberal your courts are, but with the trend towards law and order folk in power in government, the trend towards appointment has been equally as conservative.

Here's what else I know from a personal perspective - win or lose, it's always much better to be heard.

It will take a couple of years before you hear the end of this, but you will be heard.

He received a letter from the District Attorney congratulating him on the leave to appeal. Along with that , he was given a paper that stated his attorney had until oct.17th to file and then the respondant had 30 days from there. Said court date March 2017. What i am trying to find out is what could possibly happen? What choices will the courts give to him? I have heard either 1. Immediate release 2. Sentence reduction 3. retrial. Is that actually what he is up against?
