Denied parole & shock: PRD 1/2019, Parole Hearing 2/2019?
Hello , I’m just confused any information or input you can give me I will be grateful for. My bf took a plea 1 to 3 .... before he went upstate he was already on the island for 12 months .... 2 months later he went to the board n he was denied due to him not completing programs they gave him another 11 months . He was in program for 3 months and then transferred to shock .... denied shock. When I go to nys doc. It states parole hearing type reappearance. parole release date and conditional release date 1/2019 and parole hearing date 2/2019... is this possible, has everyone heard of this ??
For indeterminate sentences, this occurs when you have not been granted release by the Board of Parole, but have served two-thirds of your maximum sentence and there has been no loss of good time. For example, if serving an indeterminate sentence of one to three years, you could be released by the Parole Board after serving the minimum of one year. If not, you are eligible for conditional release after serving two years.
He's going to release on his CR date (by law) if he did not lose good time.
Parole board is in charge of discretionary releases.(decision).
When he went to the board after a few months he did not be e enough programming for them to decide so they HELD him for 11 months. But they probably set his parole conditions, being aware that his CR will occur prior to next Parole appearance.
So he does not go to a board again unless he messes up. That's when he passes CR and appears at the HOLD date.
Bottom line, if he's keeps his stuff out of trouble he's out on CR.
