My husband will be getting out and paroled pretty soon. Does anyone know what they use to determine the county of last legal residence? Is there a way to find out what county they are using before he gets out? Before my husband went to prison he was living with me and my parents in Alameda County, but I think he used his mom's address in San Joaquin County for mail. We really want to stay in Alameda County and I'm trying to find an apt. for us before he comes home, but I'm worried we might have to stay in San Joaquin County. Also, my husband says we need an address ASAP because if we don't have one they will send him to his mom's, even if that is not his county to be paroled in. Any help would be greatly appreciated!
From what I understand what ever address was used on his arrest papers and court papers is the address they use to figure where he will be paroled to. Also to correct your husband if he does not have a address before he is paroled he will "Self Parole" to the county they parole him to and will just have to check in every day until he gets a permanent address. When he signs his parole papers it will list the county he is paroling to. If I am wrong about any of this I am sure someone will come along and correct me.
The address on our court docs is different from the address that we were living at when he was arrested. Do we know how that will work? I still have time before he is paroled but would like to get paperwork straight before anything happens.
They go by the address he gave the officers when he was arrested for the case. If he changed his address while the case was going through the courts, then I'm pretty sure they would use the last address he provided them, but you can't go back and argue that the address he gave the court wasn't really his address. However he could apply for a transfer- if the county is open for parole transfers
Our case was in the courts for almost 2 years and probation which he had to go to for an interview has the address that we are at now. Does that make a difference
