I'm against the death penalty, but then we get LWOP which is also under scrutiny. Being a high profile case this should garner much attention.

I can't get past the fact it took 15 years for an opinion to come down on a direct appeal!

Default Scott Peterson death penalty overturned by California Supreme Court

“Peterson contends his trial was flawed for multiple reasons, beginning with the unusual amount of pretrial publicity that surrounded the case.," the court said. “We reject Peterson’s claim that he received an unfair trial as to guilt and thus affirm his convictions for murder.”

But the justices said the trial judge “made a series of clear and significant errors in jury selection that, under long-standing United States Supreme Court precedent, undermined Peterson’s right to an impartial jury at the penalty phase.”

That's about the average for appeals if I'm not mistaken

He wont get out of prison, either way. I'd guess the only major change would be that he wont be housed on the row.
Seems that those in CA who get the death penalty just die of natural causes rather than a needle.
Still on the fence about the death penalty. I know....not popular but the poster child for the death penalty.....guys like Richard Allen Davis, make it difficult for me to think otherwise.
