Default ICE hold but now has parole location and conditions

Id like to know if it is routine for a prison inmate to be given a parole date, conditions of parole and location of parole office when he is supposedly on an ICE Hold. He is a Legal Permanent Resident who is due to be out in February 2019. Will ICE pick him up anyway? If so, when? Thanks in advance for any clarifying information.

I don't know now how it works but ICE used to pick them up and process them out making sure all was right with their legal res status. But everything is different now so I hope the process hasn't changed.

I would expect ICE to be waiting for him at the door to the prison and for him to be handed straight to ICE.

I would advise you to seek clarification directly from your local ICE office, you still have time to find out what is going on. The inmate should also speak to whoever handles discharges about the detainer.

He would not be the first person with a green card to be deported after finishing his time. Just saying.

Ice has nothing to do with California. California follows its process and paroles a person, complete with conditions. ICE is federal and a completely separate jurisdiction. Since he will be in the custody of ICE upon release from prison, his parole and related conditions in California will toll. Should he win his deportation case with ICE, he will change custody back to California and pick up right where he left off - on his first day of parole with all of his parole conditions applicable.

His permanent resident status will not keep him in California's jurisdiction. He will be transferred to the feds. But again, should he win his ICE case and be released from ICE custody, he will be transferred back to CA custody to start his parole.

Hopefully by now you have gotten a clear answer, what is his nationality? I ask because my SO is currently in ICE custody and will be released (down to single digits) but he is Cuban and I know it differs for others

If he has a Federal Detainer on him, the releasing agency will hold him up to 48hrs for ICE transfer. His offense will dictate his hold/removability status. Anything aggravated is "wham bam...see you man" these days.
