ok if someone can answer me this..his sentence was 5 years...his release date on the BOP says 5/22/15...and when i try to calulate his good time it says he could be out august 14,2014...does that sound right???

My fiance was sentenced to 77 mths, he had been in jail awaiting sentencing since Sept 13 2009, and had even been in jail from June 2008 through December 2008 for the same charges before he was let out on bail. If it sounds confusing, it's because he spent 6 mths on the "run", dummy! Anyway, the judge did give him time served. And he was sentenced on Oct 17 2011. How much time does he have to serve?

So crime committed June 2008, arrested June 2008, sat in county until December 2008, released on bond, then he was suppose to go back for sentencing and he ran. Feds caught him in Sept 2009 and he's been in county ever since then.

The way the bop awards good time is 47 days for each year of a sentence. 60 months or 5 years can earn 47 X 5 days or 235 days of total good time. 69 months or 5 3/4 years gets 270 days and the same is true for any sentence of one year and a day or longer. A year or less gets no good time.

The expected release date includes the maximum amount of good time subtracted from the total sentence and can change if any good time is lost for bad behavior. It should be calculated from the starting date of when he was first in custody for the federal charges he ends up being sentenced for. If he spends pretrial time in jail, that time counts towards his release date and he is earning good time during it too. If he is released on bond or even on pretrial house arrest, that time does not count. If the computation is wrong, have him appeal it. The US Marshals have a record of every pretrial day he was in their custody, so it is easy to prove if the bop omits it from their calculation.

my husband got sentenced 12 months 1 day. He went to jail in 7/11/11. When will his released date be approximately?

Approximately he's got about 4 1/2 months left

So if they only had 12 months and one day, and were told they would get to go to halfway house, what would the time be? Im confused lol

How many months of hwh did his case manager say he was getting I'm assuming 3 but he should know

I dont know, The judge said on sentence the complete max would serve is 10 months. And said Would also get to go to halfway house. Prosecuter told her that he believed she would only do around 3 months... Her trouble was over 4 years ago and got herself on the right track, got into rehab programs and turned her life around. Then over 2 years later they arrested her on these charges. She was a completely different person before they even charged her.

Usually which is more often than not bop does what they want from what I've heard...ask her she may know n it may be 2 months so she'll be in the hwh in 2 1/2 months maybe sooner

They did say it was up to the BOP. But that was what they would think. Because of all her changes she did on her own. Judge said she honestly didnt need to go there, but had to make a sentence. Her suggested sentence was 14 - 20 years though.

There is a big difference between a sentence of 1 year and one of 1 year and 1 day. The 1 year serves 1 year, while the 1 year and 1 day can earn 47 days off for good behavior.

The amount of HWH time awarded is totally up to the unit team and is very subjective. I got 3 months HWH after maintaining clear conduct throughout my 5 year sentence, so there is no way to estimate the actual amount. The bop can give up to a year of HWH time, but almost never does. I knew a number of people whose HWH time was determined by when they had 10% of their sentence left to serve.

I am asking this question for a friend so if I don't make any sense don't blame me lol but my co-worker said her son was charged in summer of 2007 but convicted in feb of 2008 to 210 months in federal prison shes not sure of the exact month he was arrested but according to bop his actual or estimated date of release is 12-02-2022 so could you give me a estimate of when he would be home ? Sorry this is all the info I have I could ask her more if you need it but I am not sure she understands and I definitely don't ...thanks

Well if I calculated right 210 months is 17.5 years and 85% (is what they have to serve minimum) that is 14.875 years so adding that to 2008 it looks like what the BOP site has down to be about accurate of his release time frame! Hope that helps!

The BOP date has the 15% calculation in the formula. He may get to spend the last 6 months in a local halfway house.

I tried to figure a sentence he got 177 months has been in incarcerated since October 5 2011. He has to serve 120 months consecutive the the 57 months. In federal at 85% if all goes well when approx will he be home.

how much time will he serve on a 51 month sentence then given 500 hours for rehabilitation i guess that is the halfway house part

I don't understand the breakdown of his sentence. Is it two sentences to be served consectively? If he was sentenced to a total of 177 months, he can earn 693 days good time (14.75 years X 47 days for each year of his sentence) or about 23 months off. He could be sent to a HWH anywhere up to one year before his release date, but the way things are now, 6 months is more realistic. He will still be serving the end of his bop sentence while he is in the HWH. He can be sent home to live under home confinement from the HWH, but he will be released from bop custody (HWH or H/C) on his release date, which is when his probation will begin..

Flores: He can earn 200 days good time or a little more than 6 1/2 months off of his sentence. He can also qualify for HWH at the end of his sentence. The amount of HWH is up to the bop, but somewhere around 5 months is the most likely amount of time. Same as above regarding home confinement, release and probation.

As of now, the only way to earn additional time off is to complete the residential drug program, which can earn up to one extra year off.

We're still waiting on the outcome of the trial so this is a what if kinda question. If he gets 1 yr and 1 day but spends 6 months of that before transferred to federal prison would he still get the good time taken off?

Yes he will get good time on a sentence of one year and one day (but none if the sentence is one year or less). Every day he is locked up on the federal charge counts, no matter where it is served.

There have been times when people had to fight the bop for credit for days served in county jails even though they were in US Marshal custody. The Marshal's records can clear that up if it does happen.

Hi mi husband is going to get sentence on june 14 2012
for 6 years he is been in jail since 2-29-12 he has to do at least 25% of the time so when does he get out can someone please help me out

It sounds like a state sentence because of the 25%. If it is federal, he must serve 85% and could earn a maximum of 282 days off his 6 year sentence.
