Default Adjudication Withheld Felony on Visitation Application

Hello, everyone.

My buddy is in the Branchville facility. I'm trying to set up visitation, but one of the questions is have I been convicted of a felony. I have adjudication withheld on a felony from Florida, and one reply from this website on a different thread says as long as I have completed all probation etc., I can say no.

Does anyone know whether I can safely answer this question (on the visitation application) yes ?

Thanks, and hope your guy/gal gets out soon and ok.

Bill

I would suggest calling the agency in question. There are rare occasions where consequence attaches to a deferred disposition and results in the disposition being treated in the same manner as a conviction. It would suck to answer 'no' and have this be one of those occasions...

thank you for that quick reply.

I will do exactly that. Branchville, at least, answers their phones quickly and does try to answer family/friend questions, so I'll do that on Monday. I wasn't sure that the facility itself was the place to ask, so that's why i didn't just do that in the first place.

I think you should tell the truth. If you lie on the application and they find out you could be banned forever. If I understand correctly this was in another state . You can attach an explanation on the circumstances.
