My husband was sentenced to 108 months on September 2011. He was charged with a nonviolent crime, is a US citizen and first time offender. He is in the RDAP program and release date is May 2019 on website. Does this already include his good time credit? RDAP? Can he still get half way house to make release date before what is listed on website. Or is the 2019 release date the soonest he can get out? Thanks

The extra time off of his sentence for RDAP will be calculated after he has successfully completed his residential drug program. The same for when his unit team decides on any enhanced HWH or home confinement time. HWH/HC happens before his release date

Until that happens, his release date on the bop inmate locator will be his entire sentence, minus 100% of his regular good time of 705 days. Any HWH/HC will happen prior to his release date, and he will still be in bop custody there, just not living in a prison..

I guess what confuses me is that his sentence was 108 months which is 9 years. He started his sentence Sep 2011 add 9 years his release would be sep 2020... so not sure where they get the release date of May 2019 on the website. Is he already getting credit for good time, RDAP, or half way house or is that still pending and he could actually get released before May 2019.

Jg2011, ask him what his paperwork says. That's the only number that matters.

Hello I've read a couple of the comments and I'm dying to know if anyone could help me calculate 5 and 1/2 years I've been counting the days and he has 1800 days left on his sentence I don't know if that includes the halfway house time that's the date that they have on the FBOP website is July 11th 2022

Default Is My Sentence Long Enough For RDAP ? And How Much Time Will I Do ?

Hello, I was arrested 2/22/17 and posted bail 3/3/17. I was sentenced on 8/23/17 to 24 months my s/s date is 10/27/17. The judge also recommended RDAP and FCI Jessup. I know from reading posts and replies on this thread that the recommendation is exactly that and nothing more ( NO GARUANTEE ). Also, my girl is getting government assistance in a month or so to help with daycare so I'm wondering if I'm accepted into RDAP will that effect me. Thanks in advance... SLYKRIC

I've never heard of an instance where a girlfriend (or spouse) receiving government assistance would have any impact on your acceptance to RDAP.

162 month sentence will earn 635 days of regular good time at 47 days for each 12 months of his initial sentence.

a 27 month sentence will earn 106 days off.

In both cases it is possible to spend up to one year at the end of their remaining time in "community corrections" (see the Second Chance Act), a half way house or living at home on home confinement. The actual amount will be decided by the bop unit team, the warden. and the availability of HWH beds.

Supervised release begins on the first day after the release from bop custody.

Good time of 106 to 108 days off. I'm not sure how they compute good time for partial months, but I never heard of any initial sentence that wasn't stated in whole months.

Community corrections time (HWH or home confinement) of up to one year happens before the eventual release date, but you are still "in bop custody" there.

My husband was sentenced to 12mths 1day and 6mths halfway house. How soon can he get to the halfway house?

my son will go to prison soon and he has 51 months this is his first time could someone please tell me about time cuts and who to talk to about them and how much time is he really facing thank you

There are a bunch of websites with calculators that can give you a good idea of the dates, also as I just learned with my husband (who reported in December), he will received a letter within about a month after reporting which will give him his release date, which includes good behavior time, and in my husbands case it also gave his home detention eligibility date and his full release date (if he didn't get good behavior). These were all in line with the online calculators. Also, the BOP inmate calculator after he is in custody, will show his release date (with good behavior) after a few weeks, but before he gets the letter. It is all really helpful.

But at the end of the day, the good behavior is the key. My husband is at a camp and one of his roommates last night got taken and put in the SHU and is now being transferred to a high security prison. I don't know what he did as my husband has been itching to tell me since he showed up but I haven't visited him yet, and whatever it is is bad enough that my husband couldn't tell me on the phone or in email and has been waiting all this time (I've known something was up from Day 1) so I will finally know this weekend. So at the end of the day, he needs to stay out of trouble do his time and get out. RDAP will also cut time off if he got into that!

A 51 month sentence earns 299 days of regular good time off. If he qualifies, he may also be eligible to take the only other program that earns additional time off for successfully completing it. The residential drug abuse program, RDAP, awards up to one additional year off. He should ask his bop unit team if he qualifies to take RDAP, but more importantly will he be eligible to earn extra time off for completing it, two different things.
