Default Just Arrested

My cousin was just arrested for a gun store robbery. He has never been in trouble with the law before. Will he do jail time? I know its a crazy question but will the Feds give him probation?

Hi welcome to PTO. Now for your question I doubt he'd get probation, I'm pretty sure he's going to get a pretty long sentence behind robbing a gun store.

Yes he will get jail time. Robbing a gun store is pretty serious.

Until he is actually charged, you won't be able to know the range of punishments he is facing if he is convicted. I agree that an armed robbery of a gun store is a serious crime, but the prosecutor's charging decision will provide you with more information about his case. Sometimes they want or need someone to cooperate with the prosecution, which often results in a better sentence for that participant.

He needs a criminal defense lawyer right away.

Federal offenses are sentenced using the federal sentencing guidelines. You can find the chart on google. It has four horizontal zones, A through D. A is probation, B is a combination of house arrest and probation. C is house arrest and D is prison. There are then four columns IIRC for criminal history. The sentences are in months. These are guidelines not certainties. You need to see what his offense level to see where he is on the chart.

Even though he is a first time offender, seeing it is a violent crime he almost definitely will be imprisoned. Additionally because it is violent he is NOT eligible for the safety valve.

Your cousin needs a criminal defense attorney who is experienced in federal court. The rules of procedure are different than state courts so it is paramount he get a federal criminal defense attorney.

He should under no circumstances talk with agents or the prosecution without an attorney.
