MICHIGAN LAW MAKER KEPT ADDING MORE AND MORE RESTRICTIONS COLLATERAL SANCTIONS AGAINST SEX OFFENDERS OVER THE YEARS.

The Plaintiffs in this case—identified here only as five “John Does” and one “Mary Doe”—are registered “Tier III” sex offenders currently residing in Michigan. It is undisputed on appeal that SORA’s 2006 and 2011 amendments apply to them retroactively. That law has had a significant impact on each of them that reaches far beyond the stigma of simply being identified as a sex offender on a public registry. As a result of the school zone restrictions, for example, many of the Plaintiffs have had trouble finding a home in which they can legally live or a job where they can legally work. These restrictions have also kept those Plaintiffs who have children (or grandchildren) from watching them participate in school plays or on school sports teams, and they have kept Plaintiffs from visiting public playgrounds with their children for fear of “loitering.” Plaintiffs are also subject to the frequent inconvenience of reporting to law enforcement in person whenever they change residences, change employment, enroll (or unenroll) as a student, change their name, register a new email address or other “internet identifier,” wish to travel for more than seven days, or buy or begin to use a vehicle (or cease to own or use a vehicle). See Mich. Comp. Laws §§ 28.722(g), 725(1).

So, NO sex offender laws can be retroactive? If so, that could possibly get My Mr OFF the Registry altogether!

Read the case and look at page 1-2, and look at all the attorneys involved, try and find the attorney from kentucky, and contact them.

Data;

The number of registered sex offenders in Ohio at any given time changes every day. On November 9, 2015 it was 18,690 actively registering offenders7 . A breakdown with the numbers of offenders in each category is attached, Appendix A.
The number of sexually oriented offenders incarcerated in the Department of Rehabilitation and Correction (DRC) on November 1, 2015 was 10,141 . The number of offenders incarcerated with a Chapter 2907 sex offense as the current most serious offense was 7,233 and the number incarcerated with a Chapter 2907 or sex offender registration violation offense as the current most serious offense was 7,775.8

Furthermore, DRC trend data on prison commitments pre and post Adam Walsh shows 547 inmates incarcerated for violating sex offender registration laws. Inmates convicted of 2950.04 – Duty to Register, 2950.05 – Notice of residence address change and 2950.06 – Periodic verification of current residence address offenses have increased from 318 inmates (4.3% of total sex offender population) in July 2006 to 547 inmates (7% of the total sex offender population) as of January 1, 2016, resulting in a prison bed impactii of about 250 beds. The overall population has since stabilized to about 550. The combination of 2950. 04, 05, 06 is third most frequently admitted sex offenses today– behind rape and sexual imposition. The trajectory over time and peak in 2008-2009 mirrors intake explosion in prison population in general and is consistent with broader pattern, however after 2008-2009 there has not been a subsequent decline like for other commitments.9 This information is further illustrated in the attached data brief Appendix B.
