Default Missouri House Bill 1614 on Death Penalty

Missouri House Bill 1614 proposes to stop all state executions in Missouri until the year 2012 in order for the proposed "Commission" to completely evaluate the Missouri death penalty system and application thereof.


The five areas the "Commission" would have to address in their report are:

(1) Defendants who are sentenced to death are in fact guilty of
first degree murder;

(2) Defendants are provided adequate counsel and adequate
resources at trial and at the appellate and post-conviction

(3) Race does not play an impermissible role in determining
which defendants are sentenced to death;

(4) Appellate and post-conviction procedures are adequate to
correct errors and injustices occurring at the trial level,
including access to evidence for forensic testing; and

(5) Prosecutors throughout the state seek the death penalty in a
uniform fashion.

It seems to me that this Bill is a day late and dollar short, as none of these issues should exsist in our modern day society. The fact that this Bill has been filed certainly raises genuine issues as to Missouri's current system of government and the manner death penality cases are handed out.
