Default Absconded parole for 6 months, now in jail w/ new charge.

Okay so my husband ran for 6 months on parole. He went to jail a month ago but he's facing a possession case while in jail which he hasn't pled guilty to. Waiting for the parole officer to come see him to see if their going to revoke or reinstate him and add the time ran to his parole. He has delayed action by the parole board and I'm just scared any ideas

Be patient and wait, that's all you can do. Unfortunately its up to the field supervision officer to make a decision regarding his future.

Unfortunately being that he caught a new case while on supervision, that is a laws violation. Laws violations in 90% of all cases result in a decision to revoke supervision and have the offender complete their required backup sentence.

From personal experience as an ex-offender in the Missouri DOC system, be prepared for him to go to prison, because its highly likely he can and will be going to prison.

and on a side note, its up to the judge whether he gets his absconder time added to his sentence or not, they are not required to give it him.

What’s the length of time a person not reporting on parole before it’s considered absconding? I was told you have to not report for 90 days before they can consider it absconding. Is that true or not ?

Failing to report is failing to report. If you are assigned to see your probation and parole officer on Monday and you fail to report as ordered/scheduled then you have just violated your parole. If the the supervising officer turns in a report and a warrant is issued, you are an Absconder from Probation or Parole. Time sensitivity and dates between when you last reported have nothing to do with being an Absconder and have no bearing on if you get a warrant for your re-arrest or not.
