Volusia county will only if he's incarcerated there. Also Gulf county does as well. So there are 2 more marriage license.

Per the Clerk of Court in Union County (Lake Butler), they are one of the few counties in Florida that will issue a marriage license even if your loved one is in another county. And they will do it for you even if you DON'T live in Union County!

They are/were AWESOME!! I had a hassle free experience and the clerk was as sweet as a button. I thought I'd get someone who may show prejudism especially since I live within the confines of the "iron triangle" but she actually gave me marital advice and told me to "work hard at my relationship because anything worth having is worth fighting for!"

I've been HAPPILY married now for 5 1/2 months!! Wooo Hoooooo!

KUDOS to Union County!!!

Glades County does but only for those that are in Moore Haven CI.
Dade county will issue no matter where you or the inmate is at but you MUST have the approval letter when you go in..

Sumter - no
Polk - yes, but they require the DOC letter and a letter from the actual institution that he is housed at.
Lake - yes with no DOC letter required at all and no print out from the DOC website.

My Fiance Put In His Request This Past Saturday. He's In Wakulla County. [franklin Ci], In Tallahassee. Does Anyone Know If They Issue Marriage Licenses??
&& Also, About How Long Did It Take To Get An Approval From The Chaplain?

It took us 5 months. The paperwork must be approved on four different levels at the institution and then it goes to Tallahassee.

Default Will i need his id???

hello all! I just got my request to marry paper in the mail yesterday & i am sooo excited.. BUT - I have a quick question;;
does anyone know if i will need his picture ID when i go to apply for the marriage license? Or can i just have his birth certificate & social security number??
He lost his ID a while back & never got around to getting a new one before he got arrested!
any information will be greatly appreciated!

It will depend on what county you use to get your license. I didn't have to have Ben's ID, birth certificate or SS card.

any idea about Hillsborough County?

and does it always take so long? My fiance is in the Falkenburg Road Jail....and He is about to be Extradited....were not sure when...or how long he will have to be gone...


We wanted to be married first....

i know that it's been listed as a go, but i just got off the phone with polk county....and they were very nice...i would have to go there and fill out the forms...get them notarized and read a handbook...then i take the papers to him to fill out and get notarized and to read the hand book....take that back to them to fill out...and type up the licence, take it back to him to sign...and it goes back to them, after a 3 day wait we can get married....

lots of running, but well worth it.

okay i talked with Hillsborough County....they are closer to me...

They will do it as well... My man has to get a letter of permission to marry from the jail with both are names on it...i take that to the clerk of court....and fill out the papers, to get notarized....they issues a temp liscence...that i take to the jail for my man to fill out and get notarized....that goes back to them..i pay $104.00...we wait 3 days and can get married. =)

you also have to have the warden (or asst warden) sign off on it when it gets back from Tallahassee. you should also know that if he does anything and I am talking anything before those papers get back it can put a stick in the spokes and stop everything dead!!!

Ours took 37 days

My husband has been in since 1994 and has never had a DR or a CC and we have never lost any visits or even been talked to on our visits plus we have known each other for 10 years...

Kelbo'sWife, Our license was issued in the panhandle. A long way from Ft Myers where you are. I would check out the county's between you and where you fiance is to see if there is one that you can stop at on the way to visit on a Friday sometime. If you happen to pass through Union Co, they seem to be very easy to deal with.

i'm waiting for my paper work to come back and i was told that pinellas would issue one too. i hope so cause before my baby and i started the pape work i went to pinellas county to get some info and they told me they do. i'll see soon.

Under the Holmes County Clerk of Courts FAQ, I am copying and pasting the section regarding marriage:

Marriage/Divorce
Q: Is there a waiting period in the State of Florida for getting married after a couple applies for a Marriage License? Are blood tests required, and do you have to apply in the County you live in? Can a minor apply for a license?
A: Yes and no. There is normally a 3-day waiting period as of January 1, 1999. However, if both parties have taken a 4-hour premarital preparation course given by a minister or counselor registered with the Clerk of the Circuit Court, the waiting period is waived and the license fee is reduced.
If only one applicant took the course, the waiting period is still required.
If neither applicant is a Florida resident, the waiting period is not required.
If one applicant is not a Florida resident, and the other is a Florida resident and has taken the premarital course, the waiting period is still required.
Blood tests have not been required since this test was abolished October 1, 1986.
A marriage license may be applied for and solemnized in any Florida county.
Minors, who under oath, swear that they are parents or expectant parents of a child may apply. In addition, the pregnancy must be verified by a written statement from a licensed physician.
A previously married minor may also apply.
A person age 16 or 17 may apply with the consent of both parents or guardian, unless the parents are divorced and only one parent has full custody.

I am questioning the bolded statement above. I thought that you had to be a resident of the county you are applying in--but apparently not? Can anyone clear this up?

That information applies to the whole state of Florida. You would need to call them to inquire whether they will issue a license to you since only since your intended spouse is incarcerated. So far the counties listed in the previous posts are the only ones we know that will do this as most require both parties to be present. Let us know what you find out.

I got our license in one county and was married in another because the county his facility was in would not issue the license, so the bold statement is true.

My fiance and I have been approved and given a date to marry on the 24th of this month at the Fort Myers Work Camp does anyone know a county in FL where I can obtain a license with just me I have his full power of attorney does anyone know a county that will be able to issue me a license with it only being me in the same day being that I am pressed for time and I live in GA Please anyone help

Congratulations on the wedding!

You don't have to have POA to get the license without him. But you will have to allow yourself more time than 1 day since you don't live in FL because you will have to wait the 3 day waiting period. There is a post above that list all the counties that will issue the license without both of you being present. The best thing to do is find out how the facility will work with you to obtain his signature as well as what the county requires. I had to get Ben to sign the license and then return it to the County before my license was actually issued. I believe Brevard is the county that will do everything by mail, but you would need to get a move on to get everything done by the 24th.

Thanks Ben’s girl, I got the paper work and affidavit back from Brevard County, FL. Friday my only problem is getting his affidavit back in time or does anyone know if I use a lawyer do I still need him to sign or does the lawyer do everything? And when using a lawyer how long does it take?

Gulf county did it in 2007. However, they said that they may be discontinuing soon. Therefore, I do not know if they still do it or not.
