Default Help I need to file for divorce before he gets out

My old man is locked up in Wrightsville unit. I move to another state so that he can not find me. He was abusive and on drugs real bad. I think that he would sign divorce papers but not sure where to start I don't really have the money to pay a lawyer. But I know that I will not be able to find him once he is released.

You can file yourself. Go to your local public library and ask for the do-it-yourself-divorce forms. The library should have a book that has all sorts of forms in their Reference section. Copies shouldn't be 10 cents +/- However, the librarians cannot (by law) help you with filling out the forms or answer any legal questions.


EDIT: The courthouse can waive any fees associated with filing, just ask.

From your state abbreviation I will assume you live in Arizona I will give you some real basic information. Read the information in this booklet Things You Should Know About Divorce in Arizona Here is some information from the Arizona state bar Understanding Divorce
here is information on Dissolution of Marriage without Children in Arizona,
these forms at this site are generic. The county in which you are filing in may have other forms check with the county in which you will be filing in You can obtain more help and information here AZCourtHelp.org If you do not live in Arizona let me know. I can obtain divorce filing information for most states. I also suggested that you obtain some type of legal counseling before filing your own divorce.

First you have to figure out jurisdiction. Generally, it is the state where you lived as a married couple. Then you can go to the state court website and generally download the forms.

Here is what I would do if I couldn't afford an attorney and wanted to get divorced from an abusive man before he got out of prison:

1. Go to a domestic violence shelter. Ask for counseling. Ask for legal help. Generally there are attorneys and paralegals who will help out at low or no cost associated with your local DV shelter. May take a few days to arrange an appointment with a lawyer, but you will get help from an attorney who wants to help DV victims. Take all of your documentation with you when you meet up with the lawyer - your marriage license and information, his full name, D.O.B., social security number, your similar information, any information that you have about the abuse you suffered.
