Default TDJC Affidavit of Informal Marriage

Has anyone recently filled one of these out? My fiance is trying to get me to do it already so we can have contact visits but I'm scared to have it legally binding. I have read different places that it is legally binding but then I read that it isn't if you only file with TDCJ and not your local court house. Any input?

You either held yourself out as married in the community or you didn't. If you didn't, then I would NOT recommend claiming common-law status for visits.

We did but I am just not sure it I want it to be legally binding while he's in there.

If you file a common law marriage it IS legally binding. If you are not common law married you can't file an affidavit of marriage. You have to have lived as man and wife in order to file. If not you both can get in trouble and then you would have to get legally divorced in order to marry again. Think very hard before you file just to get contact visits.
