Default 2nd degree attempted murder sentence

Doing time for attempted murder 2nd degree... What was the sentence and/ or plea agreements?

Again, Attempted 2nd Degree Murder inn NY is a Class B felony that carries up tp 25 years.

There is no way to reasonably accurately predict what type of plea offer and sentence might be offered in your loved one's case based on plea and sentence offers in other cases. Different counties, different judges, different prosecutors, different defense attorneys, different facts, different defendant criminal histories ...

You would be doing yourself a huge disservice even trying.

As stated, there are many factors that will determine plea offers and what is handed down at sentencing.

Murder in the Second Degree is codified in §125.25 of the Penal Code and is a Class A-1 felony. Murder in any degree is causing the death of a person. To be charged and convicted of second degree murder the following events must have occurred:

The defendant has intended to kill someone and in carrying out that intent they have killed that person or a third person.

The defendant has acted recklessly so as to cause the death of someone and the situation has shown that they had a “depraved indifference to human life”.

In the course of committing the felony of robbery, burglary, kidnapping, arson, rape, and/or sexual abuse, and in doing so or fleeing from the crime, they cause the death of a non-participant. The is also known as second degree felony murder and can be charged even if they are a accomplice of the person actually killing someone in the course of the felony.

The defendant (over the age of 18) has acted recklessly so as to kill someone under 11years old and the situation has shown that they had a “depraved indifference to human life”.

Penalties for these first four elements of second degree murder can be a sentence of 15 to 25 years in prison.


If in the course of committed a crime such as rape, criminal sexual act or sexual abuse, the defendant (over the age of 18) has caused the death of a person less than 14 years old. This charge can lead to a penalty of life imprisonment without parole.
