As I understand it, the amount of time for a federal appeal can vary widely depending on which of the 13 judicial circuits the case is in. Have you checked your court's web site to see if it has an FAQ that might give you some indication of how fast cases are moving? Here's a list of the courts that includes links to their individual web sites: http://216.152.235.70/webdir.fwx
An appeal from the judgment of conviction, based on the trial court record, is taken to the District Court of Appeal. If denied at that level an application for certiriari can then be taken to the State Supreme Court. If denied at that level, a petition for habeas corpus can be filed in the federal district court pursuant to 28 USC 2254 (must be filed within one year of denial by the highest state court), and if denied by the federal district court, further appealed to the federal circuit court of appeals. A final application for appeal from the judgment of conviction can be filed in the form of a certiorari application to the U.S. Supreme Court.
Other post-conviction avenues are also available in most states, including, but not necessarily limited to, state habeas corpus proceedings and writs of error coram nobis. In some instances those types of actions are also appealable.
I found that my county was in the forth court of criminal appeals and looked them up in the phone book. Their recorded message gave me the web site and it also had a phone number for help. The help number explained to me how to get the information emailed to me. JeanettaAnn
Hello. I havent been on in awhile.. I havent had internet access for awhile.. I am currently borrowing my sisters comp to find out some info and see if I can get help...
My man went before the board on Sept. 23rd and they denied him...
Can anyone PLEASE tell me how I can help him with an appeal? And is there anyway I can find out WHY he was denied? I dont understand why he was denied...
my husband has filed an apeal and what I am worried about is him getting it worse than he already got it we are poor and had to take the lawyer he was given what I guess I am asking is can get worse ?
I am wondering that too now.. I spoke to my man a little while ago and he said he isnt gonna do the appeal now.. He said that he wont win anyways so why bother... But what is the worst that can happen? They can just tell him no again - right? He said they denied him from two previous arrests - one back in '84 and one in '94.... What the hell? That was at least TEN years ago.. He has been sitting in there for three years and three months of those ten... I dont understand this screwed up system... There is nothing I or he can do????
Would writing the mayor, govenor, parole board or anyone else cause any problems for him or make things worse for him?
