Default Petty Charges, Princely Profits

Petty Charges, Princely Profits

"A wide array of criminal charges send people to jail in northeastern Mississippi: the familiar DUI or robbery, or the less expected, such as public profanity or possession of beer in a dry county. But no matter the charge, odds are that if you land in lockup here, you will buy your freedom from Corbett Bonding.

Brian Corbett has sewn up the bail bond trade in this largely rural corner of the nation’s poorest state, minting millions from people charged with minor offenses. Operating out of a Tupelo storefront behind the county jail complex, Corbett Bonding pocketed $2.6 million in fees over a recent span of 18 months — 46 percent on bonds of less than $5,000, the ceiling for most misdemeanors in the state."

There is an"eliminate cash bail" movement happening all across the country. Google & facebook have banned bail bond ads (See HERE) and many state's are examining their own bond system, both bail bondsmen and by the courts (See HERE)....and for good reason. The cash bond system is highly unequitable and often being too poor to pay leads to job loss, housing loss etc. There has to be a better way that will allow those arrested to keep their jobs.

There are better ways that have been proven to work.

I asked one of the candidates for DA where I live at a campaign event what he would do for bail reform. He mentioned one simple thing that gets more people to show up -- just sending an automatic reminder call like your dentist does. A good pre-trial services department might do a lot more. His opponent wants to scrap cash bail completely.

New Jersey statewide and Travis County TX have taken some bold steps toward reform.

I live in a rural town not far from Mississippi, I have know a few who have gotten caught up in this system. I was shocked at the high bonds for a simple paraphania charge $5000. the person lives in Alabama, so bond was doubled $2000. cash to a bonds person. I know it's not much of a bond when it comes to someone who has the money but we are talking dirt poor area's.

Here's some legislation that you might want to call your Congressional delegation about.

http://reason.com/blog/2018/07/25/se...ces-bill-to-el

The libertarian magazine Reason and Senator Bernie Sanders are going to be on different sides of most things. Here they agree.

Quote:
The*No Money Bail Act*would prohibit the federal government from using any payment of money as a condition of pretrial release for criminal cases. It would call for grants to develop alternatives to money bail and to improve pretrial practices with the aim of reducing the number of people detained in jail prior to trial. And it would push states to come along with the shift by denying them access to Justice Department grants if they continue using money bail.

From the article:
Quote:
Between 400,000 and 500,000 people are behind bars but haven't been convicted—they're just awaiting their day in court. Sen. Bernie Sanders (I-Vt.) is unveiling legislation today to help them, by ending the use of money bail on the federal level and nudging the states to do the same.
If passed, The No Money Bail Act will affect only Federal defendants, each state will have to mandate their own rules & policies governing the bail system.

The act pressures the states to change their own systems via Federal funding.
