Default How do I Petition for early parole

Hey,
Hope everyone is fairing well. How do you petition the court for early release and on what grounds? Does there need to be a circumstance that you would be more likely to be granted this? Is anyone still on this website?

How to petition for early consideration for parole and other parole type things varies by state.

My recommendation would be to go to the state's website for the Pardon and Parole Board and that should have quite a bit of information there.

You do not provide enough information to give a specific answer, so here are the two scenarios:

1. This is a county sentence, meaning he is serving a max of less than 24 months and it is being served in a county jail. The decision to parole rests with the sentencing court and the inmate should contact his attorney to ask if a petition can be filed. He can also petition the court himself (pro se), but it is likely to be forwarded to the attorney listed for his case.

2. This is a state sentence, meaning he is serving a max of 24 months or more and it is being served in a state prison. There is no early parole. The Board of Probation & Parole makes the decision, and cannot do so until the expiration of his minimum term. if his minimum term has passed and he wasn't released the first time, then he was told when he will be reviewed again. Any request to see the Board sooner would have to go through his counselor, and the Board is not required to consider it unless 12 months have passed since the date of their last decision.

So regardless, inmates have to serve their entire minimum sentence before getting parole? Do you have the hearing prior to your minimum or once the minimum is complete? Lastly, does the DOC have good time?

1. State prisoners must serve their minimum sentence.

2. The inmate is interviewed by the Board of Probation & Parole prior to the minimum date (with a few exceptions);

3. There is no good time for state prisoners.
