Default Max Out

I have yet another question to ask I’m not sure how this works or doesn’t work. My husband landed in SHU again at his new facility and is in medical hold till the end of January. My husband max out date is next year in March and I and believing that’s what he is doing rather than make parole cause let’s face it who wants parole supervision when you max out all that doesn’t exist and you can go where ever you want freely..

Anyway my point is if my husband has 720 days of shu time cause his counselor said she don’t know if he asked for the max so he doesn’t have to deal with general population. But if his max out date is next year can the prison still hold you to finish your time with shu cause his max out is for the bid now so can they hold him past his max out date

I cant answer that question, but if he has post release he will still be under supervision.

Itís ok thank you for trying .. if he gets parole he will have post supervision if he maxes out you donít have any of that

But my question was if he has shu time of 720 days and he maxed out next year can the prison still hold him cause of the shu time even though his time is done with his sentence

No, they can't extend his sentence. He can serve no more than what the judge said.

Ok just so i understand this correctly if his max out is 3/2020 and he did his bid but still has shu time they will still have to release him on the date of his maximum expiration date and if so will he get released from SHU then ??

...not unless they take some / all of his good time. Losing good time doesn't "extend" your actual sentence, but it will change the release date.

I have very similar situation and my husband is maxing in May 2020 been in shu/box probably 90% of the last 3 1/2 years. I'm surprised they gave yours more shu time then his max, but no, they cannot keep longer than his max out date.
