Default Identity Fraud Vs Identity Theft..

So this might sound like a dumb question but what is the difference between Identity Fraud and Identity Theft? Does one carry more serious penalties than the other? Also if it's a state case vs federal does that impact sentencing any for these types of crimes? It seems like the punishment varies I have read stories about people only doing 3-5 years for millions of dollars in loss vs a small guy who barely touched the 5 grand mark and gets an outrageous amount of time. Is it possible to only get probation as a first time offender under the first offender act? Just wondering what others experiences are.

Once you know the exact charges they are bringing, state or federal or both, you can read the statutes on line to see what elements of the crime they have to prove and the maximum sentence allowed by each law. Your lawyer is your best source of what evidence they have and what they plan to do, and will also work to have the prosecutors reduce the charges.

White collar investigations can take a long time to complete, and until you know what is actually happening, you can't realistically prepare your defense.

Sorry, I have no idea about the nuances and differences between stealing an identity and identity fraud. My guess would be that one is an actual person's identity while the other is a fabricated one, but that's what it is, a guess..
