Question What is the new law that passed on 09/01/2010

What is the new law that passed on 09/01/2010? my brother mentioned it had something to do with shortening a 2 yr sentence? can anyone give me more info? thanks

Hi stelstar23 I am also looking for information on a law that passed on Sept 1 one that cuts 75% time to 35% time a person does on his/hers sentence my daughter is in texas on a 8 year probation violation and she wrote and ask me to check it out cause they seen it on the news But i cant seem to find any information on it i have also been told of early release on nonviolent who has the least amout of time left depending on the charge and that is suppose to be in most states so i am looking for anyone who knows anything on these law changes thank you

I'm also curious my man has done over 10 yrs on a 20 year stack time in tdcj and he went back in on a parole violation about 6 yrs ago if anyone has any info pls let me no

my husband told me sumthing bout time going from 85% to 65% but idk when it would go through and i think its federal ..and only in some states!

Apparently it's for new crimes, no retroactive.

"We frequently receive inquiries from federal inmates who want to know if they are eligible for a sentence reduction under the new law and guidelines. If you were sentenced for a crack-related offense prior to November 2010, it is possible that you may be entitled to a sentence reduction in the future. However, at this time, the Sentencing Commission has not yet made the 2010 sentencing changes retroactive to already-sentenced offenders. If the Sentencing Commission decides to make these changes retroactive in the future, you may be entitled to a sentence reduction at that time. It may take a year or more for the Sentencing Commission to make its decision."

My husband told me that this bill is suppose to be for state and federal. And that is was for everybody not just for nonviolent crimes. I'm not sure, can't seem to get an answer from anybody. I just want my man home. Am tired of only getting letters and phone calls. I need him home to help me!!!!

There was a petition on prisontalk here to sign to try to get this made retroactive. I am not sure where though.

Default Recent bill passed Medical Parole

Hello. I have been asked by my man to check out this new law as well cutting their sentences shorter. I did read they need to let so many thousads of inmates go for budget cuts, however i havent found any info on that one. Im watching though.

The bill that was just signed in california is the SB 1399 - comapsionate release was signed by the Governer at the end of September, I was very happy because of the poor medical care, the people that are in comas, my man is on dialysis and cannot even get a family donor because he is in the state. SO this really gave me so much hope. Why build more prisons, why not give them medical parole and better health care. I do plan on taking this all the way. Much Love

Also they are not retroactive. It will only pertain to anyone sentenced after Nov 1st is my understanding. Think of how much money the Government would be saving if it was made retroactive

It did pass, but guidelines won't be released until November 1st. It only aplies to cases on or after November 1, 2010. If made retroactive it could take a year.

From what I have read while trying to research this Bill myself, I have found that as of now the bill that goes into effect on Nov 1st is NOT retroactive an will only effect people that are setenced on or after Nov 1st. But I have also read that they have issued a "proposed emergency amendment to the sentencing guidelines" which they are trying to change some of the guidelines in the bill?

What I do not know is if is for just federal or applies to state to but from the best I can make out it looks like only federal sentencing???

Any other input would greatly be appreciated?

Default who's eligible for the new law passed September 2011

My husband was sent back to jail june 2011 for dirty urine on a agg robbery charge.. but he caught his case in 2007.. I'm jus wondering if he's eligible for the new law passed September 1st that's suppose to release imates early..? I hope someone has answer an can help me figure this out asap...

I am not sure what the barber is but I now that a law is being passed nov 1st that non violent offenders serving 5 years pr less after 90 days in jail will be released with ankle monitors but some stipulations apply I confirmed it with a judge and it's all over the US

It appears that this new law will only apply to federal inmates.

Oh and applies to offenders who have 11 months on there sentence. Its for all inmates without aggravated charges
