Default ICE Hearing Friday Dec. 8th. Help!

Happy Thanksgiving everybody!

update:

my man called me today Thursday
He was told that Monday coming up he has an appt. with ICE.


Just when we thought we were just over the Hump of Getting a possible Write Up, then thankfully he just got put on S Time, seen parole board warden, Counselor etc. they all said he does not have a Hold and his Counselor reassured the board that he looked into it and that my man is okay clear.

Mind you for those that don't know our whole story my man gets out Dec. 3rd next weekend!!!

man if they ain't fucking with him. sorry for my mouth!!!!

An ICE appointment now ????? this MONDAY I told my man to don't worry that everything will be okay. just this shit got me mad.


Any advice for us ?

They also did that to my hub. He was born in Australia, but is a naturalized citizen.
So it was a non issue.

It always sort of kills me that they wait til they are done with there sentence to do this.
I hope its a non issue for you guys too.

Yes like why wait till the end.My man was born in Mexico. But since he was about Toddler age he resided here in California. He went to Elementary, Middle, High School here. From my understanding he is considered a resident.


So I can't imagine them taking my baby back to Mexico he knows nada from there he was raised here in California. This is his HOME

Any advice on this ?

If he is not a citizen, he can be sent back.

Residency is not the same as citizenship. A lot of people, felon and non-felon are in the same boat. Unfortunately, with his felon status it makes it more of a done deal.

If he doesn't have legal citizenship, he will be detained and then deported. You need to ask him some hard questions--
Does he have legal US citizenship?
What was his legal status when he was arrested?
Where are his papers?

If he does not have citizenship or doesn't know his status, you might want to get a free consultation with an immigration attorney.

He has nothing but was raised in C.A.

Last time he got locked up more serious charges then what he is in for now. They let him out to C.A.

My man told me that on his last term he had an appt. with ICE middle of his Bid/ Time and they just asked him hecka questions that's all.


Sooo we hoping that it's just that not deportation or anything near that area.

Not being sarcastic in the least, but was Trump president the last time he was released?

Things have changed. Immigration regulations have changed. If he is technically an undocumented resident, he is eligible for deportation.

The seriousness of the charge only matters if it's his first misdemeanor. Multiple low-level offenses and all felonies qualify for deportation.

I'm in no way trying to scare you, but rather prepare you. If he has no paperwork, I would be calling immigration attorney's first thing Monday morning and asking for a consultation.

Sweetie, it looks like you were aware of this potential back in August. :/

Holds don't usually come up until they start processing them for release. Without a larger reason, ICE doesn't have anything to do with them until it's time for them to hit the streets again.

My best advice to you is, still, to contact an attorney. Particularly one who specializes in felony status.

UPDATE:


Sooooo........my man seen ICE today.

This is what he told me they told him

" they see he is a Resident on paper work but he doesn't have a social security card. So they said they would send him to the FEDS on Tuesday coming up Decemeber 5. They said he can fight his case and bail out from there THAT'S IF " his Counselor calls him in anytime today till Friday this week " 🤦


If he doesn't he is getting for sure released Dec 3rd and will just get a letter in Mail to present himself to Court. "



WE THINK. it's too little bit of days for him to get his paper work changed to having a Hold etc........he has about 4 business day left.


His Paper Work is signed states that I'm picking him up & he is being released December 3rd. Now.......my man told me.......


a friend he has there got his papers stamped and signed but that his state he has a Hold and gets released to FEDS Tuesday December 5. Which is the day I'm guessing there picking up guys who are done with there sentence and gotta go through Immirgation ICE.


Praying we are done an over with this Sunday. Dec 3rd and Tuesday NEVER COMES. So we be together

Have you made any plans for his deportation? Do you have contact info for his relatives in Mexico, or an agreement to meet somewhere below the border? Anything?

You cannot leave this to general prayers. You have to act, quickly!

He is not getting deported I didn't say that just now.
But I can Bail him out when and IF he goes to FEDS. That is what ICE Immigration told us today, very clearly.

So positive vibes!.

And I BELIEVE prayers do go a long way & ARE HEARD. We now going to sit and wait pray. Nothing else we can do.

I'm talking about covering ALL your bases. Yes, there's a possibility that he can be deported. If you haven't figured that into your plans, you may be blindsided.

And, if you're leaving it God's hands, how do you know what God wants? He may have other plans.

I'm a little confused. By Feds...you mean ICE? ICE is a federal agency and they handle immigration holds and deportation. Typically when we read about being picked up by federal, people mean a federal criminal case. Does he have a federal case pending?

So if he goes to "FEDS", but can be bailed out, doesn't that mean he'll still have a deportation case pending? What would he be bailing out for?

I think Nim's point is whether he's released from CDCR or bailed out from another agency, this isn't just falling off. Unless, he can prove legal status. That's when it would be wise to have sought legal advice and not wait until he's already in custody.

We're not trying to be difficult, but this reads a bit confusing.

For a better understanding on Immigration Bail Bonds, read here It would also be wise to discuss this matter with an attorney specializing in immigration.

Hey Squeezy, good luck with that ! Just know that everything will sort itself out one way or another, even if he gets deported, even if he stays longer in prison.... you guys will be together soon no matter what, and you need to focus on this ! Good luck! ICE can be a little slow.... but if you have his councelor number, you can probably contact him whenever you want. They are slow but very available !

He got called in.

Instead of getting out this Sunday.
Tuesday Dec 5th he is getting picked up by Immigration.

- He is being taken to Santa Maria, CA jail.
He will have Court Friday Dec 8th

I read there are 2 ways people Bail Out.

** Delivery Bond ( Basically pay a bails bond fight his case being out of Jail )

** Voluntary Departure Bond ( Basically saying you will leave California on your own by a certain time frame. Yea not gunna happen )


ICE also has the authority to release the person based on personal recognizance, in which case you won't need to pay for a bond. ( What I'm freaking hoping for )


Okay if anybody has more info or know links to Immigration Bails Bonds IN Santa Maria, California. Please comment or if you know something that can benefit or help our situation.


Also what about getting Married can that save my baby staying in California ?

I hope you get this figured out. I would be hitting Google for the bail bonds and about the marriage. I'm thinking a big NO is your answer. When they know people are getting married just so one can stay here it wouldn't be allowed.

This isn't a standard immigration issue because he's a felon. You really, really need the input of an attorney familiar with the most recent changes in regulations. :/
