Default First time in 5 years Hippa form expired days ago, they won't talk to me

When your husband is back in the hospital and your HIPPA form expired days ago...just venting here. I mean in 5 yrs there has been a form on file with MY name on it and suddenly, becauase it expired last week they can't speak with me!! Does it REALLY have to be so difficult??

My guess is that Health Services recently went through an audit..they have been sticking to the six month expiry on HIPAA forms for the past couple of months. I run into it with client releases that were executed longer ago than that, and it IS a nuisance...

Same thing happened to me. I'm his legal wife...emergency contact...all that but they have to wait until he signs the form...absolutely ridiculous. I'm sorry and I hope everything works out soon!!

I agree and it's hard to be a health care worker in that situation. You either violate the law and risk your job/income or you have to tell a patient's family that you can't help them. Hipaa violations are taken very seriously and can ruin careers or even put health care workers in jail.

And as healthcare provider myself I get that but....it's MY HUSBAND and there's a paper trail of 5yrs that says I have the right to know.

BUT...that also means you know that a paper trail does not save the job of the healthcare professional that violates statutory provisions regarding protected health information. Expiry is expiry...

So as a healthcare provider, you would knowingly and willingly violate HIPAA laws if you felt like doing so? Is that what you're saying? Or do you just expect others to risk everythng they have for you?

I'm pretty sure that in all the HIPAA rules and regulations, you won't find "... use your own judgement if the forms have expired."

ABSOLUTELY NOT!!!

However it would be very nice to know the status of my HUSBAND, who is now 4 days in the hospital!!!

I do think that the 6mth exp date on the form is tight and/or perhaps the regulations could use a modification.

Pls never ever come at me blaming again!!! Or twisting/assuming what has/has not been said.

I'm not going to disagree that six months is short on a form that expressly has the option for an expiration date, but TDCJ is not the only one that holds to six-month windows.

I've actually started coloring a bit outside of the lines and having the date left blank...then it gets filled in on a copy of the original when needed.
