Arkansas AG files appeal in Williams execution case
Associated Press

(2008-09-02) The state attorney general's office filed an appeal
Tuesday with the Arkansas Supreme Court of a judge's decision that
bars prison officials from executing convicted killer Frank Williams Jr.

Pulaski County Circuit Judge Tim Fox ruled last week in a lawsuit
brought by Williams that new lethal-injection procedures of the
Arkansas Department of Correction cannot be implemented without
public review, in accordance with the Arkansas Administrative
Procedure Act.

A federal public defender asked the Arkansas Supreme Court on
Wednesday to let another state appeals court decide whether to allow
the state to execute condemned killer Frank Williams Jr. next week.

In separate motions, Williams’ attorney, Julie Brain, asked the court
to transfer the case to the Arkansas Court of Appeals and deny a
request by Attorney General Dustin McDaniel for the high court to
allow the state to put Williams to death on schedule Tuesday.

Williams, 42, was convicted of murdering Lafayette County farmer
Clyde Spence in 1992 by shooting him in the face. Williams had broken
Spence’s tractor and said Spence refused to pay him.

Brain argued that the Supreme Court’s rules dictate that this appeal
falls outside of its jurisdiction.

LITTLE ROCK, Ark. (AP) - Gov. Mike Beebe says if the state Supreme
Court doesn't rule in a death-row case by Friday afternoon, he will
delay next week's scheduled execution of Frank Williams Jr.

Williams, 42, is scheduled to die Tuesday for the 1992 slaying of
Lafayette County farmer Clyde Spence. Williams had worked for Spence
but was fired after Spence said Williams broke a tractor.

Williams' lawyers are challenging whether the state followed the
right protocols when changing the way it executes prisoners. Also,
the lawyers say Williams is mentally retarded and shouldn't be put to
death.

Defense Seeks Transfer Of Death Row Case To Court Of Appeals

LITTLE ROCK -- The state's challenge of a judge's ruling barring the
use of new execution procedures on a convicted killer should be
transferred to the Arkansas Court of Appeals, federal public
defenders argued Wednesday.

Lawyers for Frank Williams Jr., who is scheduled to be executed
Tuesday, filed a motion Wednesday arguing the state attorney
general's office appeal of a recent ruling in Williams' favor belongs
in the Court of Appeals, not the state Supreme Court.

Williams' public defenders also said a motion by the state for an
expedited review should be denied.

Williams was convicted of capital murder in the 1992 slaying of Clyde
Spence of Bradley while Williams was on a work-release program for
the state Department of Correction. He has filed a civil suit
challenging the state's lethal injection procedures.
