Default How long will he actually serve?

My 70 year old father was recently sentenced to serve 2 years in the ND Dept of Corrections. (I won't go into how ludicrous this is, he is innocent, we continue to fight it.) Lawyer told us he would probably only serve 2-8 months. I am hesitant to believe the lawyer at this point. He has absolutely no prior record. He will be cooperative in prison. What is a realistic expectation for his actual time served?
